THE PART-V OF THE CONSTITUTION OF INDIA.

The Part-V of the Constitution Of India deals with The President, Vice-President, Council of Ministers headed by Prime Minister and the Attorney General.Articles 74-78 deals with the Prime Minister of India.

The President is the de-jure head of the State and the Prime Minister is the de-facto head of the Government.Article-74- There shall be a Council Of Ministers with the Prime Minister as its head and, aid and advice the President. The 42nd Amendment Act added Article 74 (1) added the words Act In Accordance Of Such Advice.Article-75 (1) While the Prime Minister is selected by the President and the other ministers are other ministers aThe Article 75 (2) the condition for continuance of the Prime Minister depends on the pleasure of the President. The Article 75 (3) states that all the ministers are collectively responsible to the House Of The People.So as long as the Prime Minister enjoys the majority in the House he can continue in his office.The choice to selects a Prime Minister is very restricted for the President.He has to select the leader of the party that enjoys the majority in the House.Or a person who projects that he will win the confidence of the House.

WHO CAN BECOME THE PRIME MINISTER OF INDIA.

  • Should be Citizen of India.
  • Member of either House of the Parliament and if not then must be elected within the period of six months from the date of his entering the office.
  • The minimum age for the member of The House Of The People is 25years and for The Council of The States is 30 years.
  • No such educational qualification is prescribed.

FUNCTIONS OF THE PRIME MINISTER.

  • Rendering aid and tendering advice to the President.
  • 44th Amendment 1978 provided that the President may require the consideration of the Council Of Ministers to consider such advice, either generally or otherwise, and the President shall act in accordance with the advice tendered after such reconsideration.
  • Article-78, it is the chief duty of the Prime Minister to communicate the President all the decisions taken by the Council Of Ministers that are relates to-
    • Administration Of Affairs Of The Union.
    • Proposal For Legislation.
    • If President calls upon a certain matter he has to provide the full information.
    • If in a case, a decision is taken by a minister then the President may require the Prime Minister to submit the consideration of the Council Of Ministers.
    • Prime Minister allocates and reshuffle portfolios.
    • Prime Minister even controls, coordinate and guides his ministers.In case on difference of opinion he may ask the minister to resign.
    • The Prime Minister acts as a Chairman of National Institution For Transforming India (earlier Planning Commission).
    • National Development Council.
    • National Integration Council.
    • Inter State Council
    • Presides all meetings of his Council.
    • If the Prime Minister resigns the Council Of Ministers automatically dies.

DEPUTY PRIME MINISTER.

There is no such provision for the Deputy Prime Minister Of India in the Constitution Of India. The Deputy Prime Minister is appointed if two persons are of same political stature, if there is a coalition government.
