THE GOLDEN RULES FOR GOVERNANCE-PART-I

Dr Ambedkar called The Directive Principles Of State Policy as ‘Novel features’ OF THE INDIAN CONSTITUTION.

The Part-IV of the Constitution contains the ‘Directive Principles Of State Policy’. The Golden Rules For Governance. Our makers of the Constitution borrowed it from the Constitution of Ireland and them actually borrowed it from the Spanish constitution. These rules are enumerated under Article 36-51. They also resemble the ‘Instrument Of Instructions Of The Government Of India Act 1935. This establishes the concept of the Welfare State and not the Police State. The Directives are Non-Justiciable in nature as they are not directly enforceable by any Court on the violation. Directives that are mentioned in other parts of the Indian Constitution. These are-

  • ARTICLE 350– It entitles a person to submit the grievance in any language used in that particular State.
  • ARTICLE 350 A– It directs the State and its local bodies that the medium of instruction at the primary level of education for the children of the linguistic minorities should be in their mother tongue.
  • ARTICLE 350 B– It states that the State should appoint an officer for linguistic minorities to investigate their safeguards provided by the Constitution of India and present a report to the President.
  • ARTICLE 351– To promote and develop Hindi so it may serve as the medium of expression for all cultures India.
  • ARTICLE 335- The members of the SC/ST shall be taken into the consideration, consistently with the maintenance of efficiency of administration, in the making of appointments to services and posts in connection with the affairs of the Union or of a State.

DIRECTIVE PRINCIPLES OF STATE ARE BROADLY CATEGORIES INTO THREE.THESE ARE THE FOLLOWING-

  • SOCIALISTIC PRINCIPLES-THE SOCIALISTIC PATTERN OF SOCIETY NOT SOCIALISM.-ARTICLES-38,39,39A,41,42,43,43A AND 47.
  • GANDHIAN PRINCIPLES.ARTICLES-40,43,46,47AND 48.
  • LIBERAL PRINCIPLES.ARTICLES-44,45,48, 48A,49,50 AND 51.

41SECURE RIGHT TO WORK, EDUCATION AND PUBLIC ASSISTANCE IN CERTAIN CASES SUCH AS UNEMPLOYMENT, SICKNESS, OLD AGE.
